These Terms & Conditions (“Terms”) govern your use of https://thefirststore.in (the “website”) and purchases made from The First Store, operated by Bentrix. By using the website or placing an order, you agree to these Terms and to our Privacy Policy, Refund, Return & Cancellation Policy and Shipping Policy.
1. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract under the Indian Contract Act, 1872 to place an order.
2. Products and information
- We try to describe and photograph products as accurately as possible. Colours, textures and finishes may vary slightly due to screens, lighting and natural materials.
- Dimensions and weights are approximate.
- All products are subject to availability. We may limit quantities or discontinue products at any time.
3. Prices and payment
- All prices are in Indian Rupees (INR). Applicable taxes and shipping charges are shown at checkout before you pay.
- Payments are processed securely through Shopify Checkout and our payment partners (such as Razorpay). We do not store your card or bank details.
- If a product is listed at an incorrect price due to an error, we may cancel the order and issue a full refund, even after confirmation.
4. Orders
Your order is an offer to buy. We accept it when we dispatch the product. We may refuse or cancel an order (for example, for stock unavailability, pricing errors or suspected fraud). If we cancel a paid order, you will receive a full refund.
5. Shipping, returns and refunds
Delivery is covered by our Shipping Policy, and cancellations, returns and refunds by our Refund, Return & Cancellation Policy.
6. Accounts
If you create an account, you are responsible for keeping your sign-in details secure and for activity under your account. Customer accounts are provided through Shopify.
7. Acceptable use
You agree not to misuse the website — for example, by attempting unauthorised access, interfering with its operation, scraping content, or using it for unlawful or fraudulent purposes.
8. Intellectual property
All content on the website — including text, graphics, logos and design — belongs to Bentrix or its licensors and may not be copied or used without permission. Product names and brands belong to their respective owners.
9. Third-party services
The website relies on third-party services such as Shopify, payment gateways and couriers. Their own terms and privacy policies apply to their services.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from use of the website or products. Our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms limits your rights as a consumer under Indian law.
11. Indemnity
You agree to indemnify Bentrix against claims arising from your breach of these Terms or misuse of the website.
12. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, strikes, courier disruptions or government restrictions.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the competent courts in India.
